3. Why do we process your personal data?

Contact and enquiries

When you contact YourTrn through our website, by email, telephone, social media or another communication channel, we process the information you provide in order to respond to your enquiry.

Depending on the circumstances, this processing is based on taking steps at your request before entering into an agreement, performing an agreement with you, or our legitimate interest in responding to enquiries from customers and prospective customers.

4. Our website and Wix

The YourTrn website is created and hosted using services provided by Wix.com Ltd. and its affiliated companies, referred to in this Privacy Policy as Wix.

Where personal data is transferred outside the European Economic Area to a country that does not benefit from an adequacy decision of the European Commission, appropriate safeguards are used in accordance with applicable data protection law, including where applicable the European Commission's Standard Contractual Clauses.

More information about Wix's privacy practices is available in the Wix Privacy Policy.

We use email information only for the purposes for which the communication was made, for the performance of our services, for necessary administration and, where applicable, for compliance with legal obligations.

6. Cookies

Our website uses cookies and similar technologies.

Some cookies are necessary for the website to function correctly and securely. These cookies may be used without your consent where permitted by law.

Other cookies, such as analytics, advertising or tracking cookies, will only be used after you have provided your consent where consent is legally required.

When you first visit our website, you may be asked to make choices regarding the use of non essential cookies.

You can refuse non essential cookies without losing access to the basic functionality of the website.

You can change your preferences or withdraw your consent at any time through the cookie settings available on our website.

More detailed information about the cookies used by the YourTrn website can be found in our Cookie Policy or cookie settings.

7. Photos and videos

Photos or videos may occasionally be taken during YourTrn classes, workshops or events.

Where an identifiable photo or video is used for promotional purposes, such as on our website, social media accounts, advertisements or other promotional materials, we will ensure that an appropriate legal basis exists.

Where consent is required, we will request that consent before using the image for the relevant purpose.

If our use of your image is based on your consent, you may withdraw that consent for future use at any time.

Additional care is taken when photos or videos concern minors. Where required, appropriate consent will be obtained from a parent or legal guardian and, where applicable, from the minor.

8. Social media

YourTrn may use social media platforms such as Instagram, Facebook, TikTok or other platforms to communicate about our activities.

If you contact or interact with us through a social media platform, both YourTrn and the operator of that platform may process personal data relating to your interaction.

The processing performed independently by the social media platform is governed by that platform's own privacy policy.

If social media content or other external content is embedded into our website and this involves non essential cookies or tracking technologies, such technologies will only be activated after obtaining consent where this is legally required.

9. Who do we share your personal data with?

We do not sell your personal data.

We may share personal data with service providers where this is necessary for the operation of YourTrn and the provision of our services.

Our service providers currently include, where applicable:

Wix.com Ltd. and related companies for website hosting, website functionality and related technical services

Zoho and related companies for email hosting and communications

Other professional or technical service providers that may be necessary for accounting, administration, payment processing, IT services or legal compliance

These service providers only receive personal data to the extent necessary for the relevant service.

Where a service provider processes personal data on our behalf, we take appropriate steps to ensure that the processing is governed by suitable data protection arrangements.

We may also disclose personal data where this is required by Belgian or European law, a court order or a lawful request from a competent public authority.

10. International data transfers

Some of the technology providers used by YourTrn operate internationally.

As a result, personal data may in certain circumstances be processed outside Belgium or outside the European Economic Area.

Where personal data is transferred to a country outside the European Economic Area, we ensure that the transfer is made in accordance with the GDPR.

Depending on the country and service provider, this may include:

  1. a European Commission adequacy decision

  2. European Commission Standard Contractual Clauses

  3. other legally recognised safeguards

You may contact us if you would like further information about the safeguards that apply to international transfers of your personal data.

11. How long do we keep your personal data?

We do not keep personal data for longer than necessary for the purposes for which it was collected.

Data concerning bookings and the performance of our services is retained for as long as necessary to manage the booking and subsequently for an appropriate period to deal with administrative matters or possible legal claims.

Invoices, accounting records and information that must be retained by law are kept for the applicable statutory retention period.

General enquiries that do not result in a booking or agreement are deleted or anonymised when they are no longer reasonably required for the enquiry or its follow up.

Email correspondence is retained for as long as reasonably necessary for the purpose of the communication, our administration or the protection of our legitimate interests.

Marketing information based exclusively on your consent is retained until you withdraw your consent or until we determine that the information is no longer required.

Cookie information is retained according to the retention periods specified in our cookie settings or Cookie Policy.

12. How do we protect your personal data?

We take appropriate technical and organisational measures to protect personal data against accidental or unlawful destruction, loss, alteration, unauthorised disclosure or unauthorised access.

We also use professional service providers such as Wix and Zoho that provide security measures for their respective services.

No internet based service can guarantee absolute security, but we take reasonable measures appropriate to the nature of the personal data and the risks involved.

13. Your rights

Under the GDPR, you have several rights concerning your personal data.

Subject to the applicable legal conditions, you have the right to:

  1. request information about how we process your personal data

  2. obtain access to the personal data we hold about you

  3. request the correction of inaccurate or incomplete personal data

  4. request the deletion of your personal data

  5. request the restriction of processing

  6. object to certain types of processing

  7. receive certain personal data in a structured, commonly used and machine readable format

  8. request the transfer of certain data to another controller where technically feasible

  9. withdraw your consent at any time where processing is based on consent

  10. object at any time to the processing of your personal data for direct marketing purposes

Withdrawal of consent does not affect the lawfulness of processing that took place before consent was withdrawn.

To exercise any of these rights, contact us at:

hello@yourtrn.com

We may request additional information where reasonably necessary to verify your identity.

We will normally respond to your request within one month. This period may be extended where permitted by the GDPR, taking into account the complexity and number of requests.

14. Minors

Some YourTrn activities may be accessible to minors.

We take particular care when processing personal data relating to children and young people.

Where an online service is offered directly to a child and the processing is based on consent within the meaning of Article 8 of the GDPR, Belgian law provides that a child may in principle provide such consent from the age of 13.

Where the child is younger than 13, the consent or authorisation of the person holding parental responsibility is required in circumstances covered by Article 8 of the GDPR.

Different rules may apply to participation in an activity, contracts, image rights and the use of photographs or videos. Where necessary, we will therefore request the consent or involvement of a parent or legal guardian.

15. Complaints

If you have concerns about the way YourTrn processes your personal data, you can contact us first so that we can investigate your request.

You also have the right to lodge a complaint with the Belgian Data Protection Authority:

Belgian Data Protection Authority
Rue de la Presse 35 / Drukpersstraat 35
1000 Brussels
Belgium
Email: contact@apd-gba.be

You also retain the right to seek other administrative or judicial remedies where available.

16. Changes to this Privacy Policy

We may update this Privacy Policy from time to time, for example when our services, website, technology providers or legal obligations change.

The most recent version will be published on our website.
